Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the Brioche application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and the operator of Brioche ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes acceptance of those changes.

Your use of the App is also subject to Apple's Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4.1 Sign in with Apple

To access certain features, you must create an account using Sign in with Apple. By creating an account, you agree to provide accurate information and to keep your account credentials secure.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4.3 Account Deletion

You may delete your account at any time from the Settings screen in the App. Deleting your account will permanently remove your account information, all saved recipes, usage data, and any images stored on our servers. This action cannot be undone.

4.4 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Premium subscriptions include unlimited recipe imports for normal, personal use. To maintain service quality and reliability for all users, we reserve the right to apply reasonable usage thresholds. These thresholds are set well above what any typical user would need for personal recipe management. Automated, scripted, or bulk imports that exceed normal personal use may be temporarily throttled. 6. User Content

6.1 Your Content

You retain ownership of all recipes, images, meal plans, and other content you create or import into the App ("User Content"). By using cloud sync or sharing features, you grant us a non-exclusive, worldwide, royalty-free license to store, transmit, and display your User Content solely for the purpose of providing and improving the App.

When you share recipes via links, recipients receive a copy of the recipe at the time of import. Shared recipes are independent copies—updates you make will not affect previously shared versions. Shared links cannot be revoked once created.

The App is operated from the United States. If you access the App from outside the United States, you consent to the transfer, processing, and storage of your information in the United States.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

14. Dispute Resolution and Arbitration

14.1 Agreement to Arbitrate

You and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App ("Disputes") will be resolved by binding individual arbitration rather than in court, except that either party may bring individual claims in small claims court if they qualify.

Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration will be held in California, or at another mutually agreed location. The arbitrator's decision will be final and binding.

YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

You may opt out of this arbitration agreement by sending written notice to support@brioche.recipes within 30 days of first accepting these Terms. If you opt out, you and we will resolve Disputes in court.

15. General Provisions

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after the effective date of any changes constitutes acceptance of the new Terms.
